(الوطن) تفند المزاعم الأمريكية حول جهود السلطنة لمكافحة هذه الجريمة
الهلالي: قانون الجزاء جرم الاتجار بالبشر وقانون وطني مستقل .. قريباً
كتب ـ المحرر السياسي: في سياق الاهتمام الكبير بمكافحة جريمة الاتجار بالبشر وما توليه حكومة السلطنة من اهتمام خاص بتلك القضية على كافة المستويات، تدرس السلطنة حاليا إصدار قانون وطني مستقل لمكافحة الاتجار بالبشر. وأكد سعادة حسين الهلالي المدعي العام أن مشروع القانون مازال قيد الدراسة ولم تنته الجهات المعنية منه حتى الآن، موضحاً أن فكرة القانون الوطني لمكافحة الاتجار بالبشر ليست وليدة اليوم , إنما تأتي تأكيداً لما تضمنه قانون الجزاء العماني من نصوص تجرم الاتجار بالبشر نظراً لتطور مفهوم هذه الجريمة.
وأضاف سعادته في تصريحات لـ(الوطن) أن ذلك يأتي التزاماً بأحكام اتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة ,عبر الوطنية, والاتفاقات الملحقة بها التي انضمت إليها السلطنة بموجب المرسوم السلطاني رقم (37/2005م)
وتأتي تصريحات سعادة المدعي العام في سياق مناقشة جادة تفتحها (الوطن) لفك الالتباس وتفنيد المزاعم التي أوردها التقرير السنوي الصادر عن وزارة الخارجية الأمريكية الذي يفترض وجود الاتجار بالبشر في السلطنة و4 دول في مجلس التعاون الخليجي والإدعاء بالفشل في العمل على منع هذه العملية، حيث رأت الحكومة الفيدرالية الأمريكية أن دول المجلس لم تظهر أي التزام تجاه الوفاء بالمعايير الدولية لمنع المتاجرة في البشر، كما تم تصنيف السلطنة ضمن دول الفئة الثالثة في التقرير.وتأتي تلك الاتهامات المزعومة لتتناقض بشكل واضح مع معلومات مكتب المخدرات والجريمة التابع لمنظمة الأمم المتحدة الذي أصدر تقريراً في عام 2006 بعنوان: "الإتجار في البشر: نماذج عالمية" وأكد أن السلطنة ليست من الدول التي تتضمن المتاجرة بالبشر بالمقارنة مع مستوى عال من هذه الجريمة في الولايات المتحدة نفسها .
ترويج (الافتراءات) ثم التفكير في (العقوبات) .. و(الوطن) تناقشحقيقة المزاعم الأمريكية حول الاتجار بالبشر في السلطنة * تقرير الخارجية الأمريكية مليء بالتناقضات والادعاءات التي تنم عن جهل .. والفعل (يمكن) لا يصلح دليلا على المخالفات * ما هي سلطة واشنطن لتصدر تقريرا حول الفشل المزعوم في الوفاء بالمعايير الدولية؟* أميركا تخفي حجم المشكلة عندها وتتحدث عن استعدادها لـ(مواجهة حكم الآخرين)* تقرير للأمم المتحدة : السلطنة تفوقت على أميركا في محاربة الاتجار بالبشر
إعداد ـ قسم التحقيقات الصحفية : في إطار العلاقات الدولية وعلاقات الدول بعضها البعض، وعلى طاولات الحوار الدبلوماسي يبدو من المنطقي تبادل الأفكار ووجهات النظر حيال مختلف القضايا العام منها والخاص ، وبنفس المقدار يمكننا القول : إن قوة علاقات الصداقة والشراكة الاستراتيجية بين دولتين تحكمهما اتفاقيات وعلاقات قوية ينبغي أن تقوم على أساس من المصداقية القائمة على علم وفهم تام بالمعطيات السياسية والاقتصادية والاجتماعية لطرفي العلاقة والاحترام المتبادل والسعي نحو إعطائها دفعات قوية للأمام بما يخدم مصالح الشعبين ، ذلك هو الهدف النهائي والأسمى للعلاقات الدولية .وبمنطق الوجه الآخر للعملة، فإن نقيض تلك المبادئ يعني الخروج بالأمور عن مسارها الصحيح والمفترض ، والدخول إلى منعطفات لا تخدم تلك العلاقات ، بل لا نبالغ إذا قلنا إنها تمثل حجر عثرة في الطريق نحو الوصول إلى نقاط التقاء نحن في أمس الحاجة إليها .وبلا شك فإن طبائع الأمور تفترض أن تنطوي التقارير السياسية الصادرة عن الدول الأعضاء على المسرح الدولي على مصداقية تامة وحيادية مطلقة وأن تكون على دراية بكل صغيرة وكبيرة في الموضوع محل النقاش ، حتى لا تتحول بـ"جهلها" إلي عناوين للتضليل وسوء الفهم ، وأدوات لترويج مزاعم تجافي الواقع ، وقد تؤدي إلى ما لا يحمد عقباه ، و"الساحة الدولية ذاخرة بمثل تلك النماذج" .والواقع يجزم بأن الأمر انتقل من دائرة التعميم إلى التخصيص في تلك الزاوية بالذات (أي مسألة العلاقات الدولية) مما ينبغي أن تكون عليه آليات إدارة علاقات الشراكة والصداقة، حينما جانبت الإدارة الاميركية جادة الصواب في اتهاماتها ومزاعمها غير المدعمة بالأسانيد والحجج والبراهين السليمة للسلطنة في قضية هي في صلب اهتمام المجتمع الدولي ، في حين تبذل السلطنة بكل أجهزتها جهدا حثيثا لمواجهتها، باعتراف منظمة الأمم المتحدة نفسها .. وهي قضية الاتجار بالبشر !! ..
اتهامات وافتراءات
فقد تفاجأ العمانيون والمقيمون على أرض السلطنة في يونيو الماضي باتهام التقرير السنوي الصادر عن وزارة الخارجية الأميركية بخصوص الاتجار بالبشر في السلطنة و4 دول أعضاء في مجلس التعاون الخليجي بالفشل في العمل على منع عملية الاتجار بالبشر، حيث رأت الحكومة الفيدرالية الأميركية أن دول المجلس لم تظهر أي التزام تجاه الوفاء بالمعايير الدولية لمنع الاتجار بالبشر. المفاجأة الأكبر هي تصنيف السلطنة ضمن دول الفئة الثالثة في التقرير ، وهي أدنى مرتبة يمكن أن تصنف فيها أي دولة في العرف الأميركي، وهي مرتبة تكون معرضة لفرض عقوبات عليها .تقرير الخارجية الاميركية الذي يقع في 236 صفحة يفرض العديد من الأسئلة المنطقية التي تحاصر العقل عند مطالعته .. منها على سبيل المثال لا الحصر .. هل هذه الاتهامات معقولة وواقعية ؟ .. وما هي الدلائل على تلك الدعاوى والمزاعم التي أطلقتها وزارة الخارجية الأميركية ؟ وهل كان هذا التقرير نتيجة لفحص ودراسة جادة أم هو مجرد افتراء سطحي غير مبرر على السلطنة ؟ .. في وقت لم يصدر عن حكومة السلطنة أي رد علني على الاتهامات الأميركية .والحقيقة أن الأمر يثير الكثير من الشك والقلق تجاه الطريقة التي اختار بها هذا التقرير الأميركي التعامل مع السلطنة .. فمما لا يغيب عن فطنة عاقل أن الفكرة القائلة : إن السلطنة لم تظهر أي التزام تجاه الوفاء بالمعايير الدولية ، وهي فكرة غير مقبولة بشكل واضح ، وفي وقت يبدو من السذاجة أن نفترض أنه ليس هناك مشكلة تتعلق بقضايا الاتجار بالبشر في البلاد ، فهناك دلائل وافرة على أن الحكومة العمانية تعمل للحد من هذه الظاهرة.
تناقضات
ومن بين النقاط التي تتحدث وزارة الخارجية الأميركية عن تقصير السلطنة بشكل خطير فيها احتجاز أصحاب العمل لجوازات سفر العمال الأجانب ، وهو ما يستتبعه التقرير بتناقض لا تخطئه العين حين يعترف بأن وزارة القوى العاملة في السلطنة أصدرت تعميماً في شهر نوفمبر عام 2006 يعيد التأكيد على أن هذه الممارسة غير قانونية بشكل تام .. إذن أين الاتهام؟. وتستمر الاتهامات في التقرير، وتتزايد معها التناقضات والادعاءات بأن هذه الممارسة منتشرة على نطاق واسع ، على الرغم من عدم تقديم أي دلائل تدعم هذه المزاعم. وحتى إذا كانت هناك انتهاكات في هذه النطاق ، فإن وزارة الخارجية الأميركية قد جانبها الصواب في مزاعمها بأن السلطنة لم تفعل أي شئ لمعالجة هذه المشكلة. فغني عن البيان أن حكومة السلطنة تبذل جهوداً ضخمة ومضنية بشكل مستمر في تعقب مثل هذه الانتهاكات ، وستبعث المحاكمات القليلة عالية المستوى ـ وقت الضرورة ـ والعقوبات الصارمة الموقعة على أي شخص يثبت تورطه وإدانته ، برسالة واضحة إلى أي جهة عمل مجردة من المبادئ والضمير تفكر في استغلال عمالها بأي طريقة. تخمين فقط كما يحمل التقرير أيضاً زعما آخر بأن "السلطنة يمكن أن تكون وجهة للنساء القادمات من الصين، الفلبين، المغرب ودول أوروبا الغربية من أجل الاستغلال الجنسي التجاري" .... فما هو الدليل الذي يدعم القول بحدوث عمليات الاتجار بالبشر في هذا الجانب ؟ إن استعمال الفعل (يمكن) وكما ورد في التقرير (may) أن ينسف الواقعة من أساسها لأن المصطلح يعني التشكيك وينفي القطع ، فهي فرضية مبنية على التخمين فقط ، حتى أن كاتبي التقرير لم يتمكنوا من التأكيد على وقوع هذه الحوادث وجعل التقرير بيانا ثابتا بدلاً من مجرد احتمال .. ولنا أن نتساءل حول موقع التخمين من الاعراب السياسي في تقرير رسمي مفترض ؟ حيث إن (ألف باء) التحليل السليم هو أن تُجرى دراسة موضوعية موثقة تؤكد صحة التقرير ومدعومة بالأدلة القطعية . لا يختلف اثنان على أن الاتجار في البشر ممارسة بغيضة لأنها تنتهك كل معايير السلوك الإنساني الأساسية، وتشكل واحدة من أسوأ الانتهاكات التي يمكن تخيلها بالنسبة لحقوق الإنسان الأساسية، كما أنها تتنافى مع قيمنا الإسلامية والثقافية.
المشكلة داخل أميركا أكثر وضوحاوبنفس المقدار فإن الولايات المتحدة محقة في القلق بشأن هذه القضية ولكن الولايات المتحدة نفسها تواجه هذه المشكلة، وذلك باعتراف مارك لاغون مدير مكتب مكافحة الاتجار بالبشر حيث قال في الثالث عشر من يونيو الماضي خلال عرضه التقرير : إن بعض النساء اللواتي يهاجرن إلى أميركا يمتهنّ مهنة البغاء ، كما أن هناك عددا غير معروف من مواطني الولايات المتحدة والمقيمين أيضا فيها تم الاتجار بهم داخل الولايات المتحدة من أجل الاستعباد الجنسي والسخرة والعمل القسري بشكل أساسي ولكن لاغون قال " في الوقت الذي لم يتم فيه تصنيف الولايات المتحدة ضمن فئة معينة ، إلا أنها مستعدة لمواجهة أي حكم يصدر عليها " وهو ما يمثل سقطة أخرى ينبغي الإشارة إليها، إذ أنه من المفترض أن تندرج الولايات المتحدة عينها ضمن فئة معينة من فئات التقرير وفقا للمقاييس الموضوعة للظاهرة وحجم مشكلة الاتجار بالبشر وشهادات الضحايا ، وهو ما تفترضه أدنى درجات الشفافية ، وبما أن التصنيف غائب حسبما يفهم من كلام المسئول الأميركي .. فكيف سيكون الحكم ؟؟!!هكذا تدق ساعة الحقيقة لتؤكد أنه لا ينبغي نشر تقارير مضللة ومشوهة للسمعة عن الدول الأخرى،وخصوصاً من قبل أصدقاء في هذا الجهد الدولي كطريق معقول لتشجيع التعاون الفعال،خاصة عندما يصدر هذا التقرير عن الولايات المتحدة نفسها التي تصر على عدم نشر التقارير التي تتعلق بشئونها الداخلية، ويتضح أنها تمتلك مشاكل أكثر خطورة من مشاكل بعض الدول التي تنتقدها في هذا الصدد .
السلطنة الأفضل نقولها بصدق .. إن مشكلة الاتجار بالبشر يمكن أن تحل فقط من خلال التعاون الدولي، ولا يمكن لأي دولة أن تتعامل مع هذه القضية بمفردها، أو أن تأمل في القضاء على الجريمة داخل أراضيها بدون مساعدة دول الجوار، والأصدقاء والشركاء ، ومن هنا لا بد من التأكيد على أن السلطنة حازت السبق في مكافحة تلك المشكلة البالغة الخطورة ، حيث إنه وبحسب معلومات مكتب المخدرات والجريمة التابع لمنظمة الأمم المتحدة الذي أصدر تقريراً في عام 2006 بعنوان : "الاتجار في البشر: نماذج عالمية"، فإن السلطنة في حقيقة الأمر واحدة من الدول التي تخلو من الاتجار في البشر وبالمقارنة مع معظم الدول الأوروبية، والولايات المتحدة نفسها، فإن السلطنة ليست وجهة أساسية للأشخاص الذين يتم الاتجار بهم حسبما يدعي تقرير وزارة الخارجية الاميركية ويصنف التقرير الصادر عن مكتب المخدرات والجريمة الولايات المتحدة كواحدة من الدول التي تواجه مشكلة أكبر في الاتجار بالبشر من السلطنة. كما أنه لا يغيب عن الذاكرة تلك الدراسة التي أعدها مؤشر السلام العالمي (غلوبال بيس انديكس) ، وأكد من خلالها أن السلطنة تعد الدولة الأولى الأكثر أمناً في الشرق الأوسط وشمال إفريقيا كما احتلت المرتبة الثانية والعشرين على مستوى العالم وأضافت الدراسة التي ركزت على مستوى السلام والأمن في كل دولة أن السلطنة احتلت كذلك مركزاً متقدماً نظراً للمستوى العالي لاحترامها لحقوق الإنسان وصنفت الدراسة (121) دولة استناداً إلى 24 عاملاً تشمل مستويات السلام الداخلي والخارجي بالنسبة للشعوب ، والعنف والجريمة المنظمة والإنفاق العسكري للدول ،ومستويات التنمية الاجتماعية ووجد الباحثون أن الدول التي جاءت في مستويات متقدمة لديها خصال مشتركة عدة على رأسها أنظمة ديمقراطية وشفافة ونظام تعليمي جيد ونال هذا المؤشر دعم شخصيات دولية مثل الرئيس الأميركي الأسبق جيمي كارتر والخبير الاقتصادي جوزف ستيغليتز الحائزين على جائزة نوبل للسلام.
حضور دولي
ولم تختلف تأكيدات المنظمات الدولية عن توجه حكومة السلطنة في مختلف المحافل العالمية ، بالتأكيد أن السلطنة قد أولت اهتماما كبيرا لهذه المسألة ، سواء كان ذلك فيما تضمنه قانون الجزاء وقانون العمل وغيرهما من القوانين العمانية النافذة من موقع تجريم كافة أنواع وأشكال الاتجار بالبشر أو بالسعي نحو الانضمام إلى الاتفاقيات الدولية والإقليمية ذات الصلة من أجل ضمان تطبيق أفضل المعايير والقواعد في مجال مكافحة الاتجار بالبشر، وهو ما أكده معالي محمد بن علي بن ناصر العلوي وزير الشؤون القانونية أمام اجتماعات الدورة السادسة والأربعين للمنظمة الاستشارية القانونية الآسيوية الأفريقية والتي عقدت في مدينة كيب تاون بجنوب أفريقيا ، حيث قال معاليه : إن صدور المرسوم السلطاني السامي رقم 37 /2005 بالموافقة على انضمام السلطنة إلى اتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة عبر البروتوكولات الملحقة بها هو أبلغ دليل على قوة التوجه العماني لمحاربة الجريمة بكافة أشكالها وأنواعها ومشاطرتها للجهد الدولي في هذا الصدد ،كما جاء تأكيد معالي وزير الشؤون القانونية واضحا حول سعي السلطنة ، منذ بداية نهضتها الحديثة ، إلى تعزيز حقوق الإنسان وتفعليها كإحدى الاولويات الوطنية في مسيرة التنمية الشاملة والى تكريس مبدأ العمل الجماعي مع المنظمات الإقليمية والدولية في هذا المجال والى الإسهام الجاد في وضعها في إطار الممارسات الفعالة والخروج بها من حيز الشعارات إلى واقع التطبيق ، وتطرق معاليه في هذا الصدد إلى إنشاء السلطنة لجنة لحقوق الإنسان تتبع وزارة الخارجية لتقييم كافة الأمور المتعلقة بحقوق الإنسان وللجنة اختصاصات لا تقل أهمية عن اختصاصات وصلاحيات أية لجنة أو منظمة حقوق إنسان مماثلة. بعد كل ذلك وغيره .. لنا أن نتساءل :
"ما هي السلطة الأخلاقية أو السياسية التي تخول الإدارة الأميركية إصدار تقرير عام عن السلطنة وفشلها المزعوم في الالتزام بالمعايير الدولية"؟.
المدعي العام لـ(الوطن) : السلطنة تعتزم إصدار قانون وطني مستقل لمكافحة الاتجار بالبشرـ مفهوم هذه الجريمة تطور وفكرة القانون ليست وليدة اليوم ـ لم تسجل لدينا أية مخالفة وما ورد بالتقرير الأميركي لا أساس له من الصحة
نفى سعادة حسين بن علي الهلالي المدعي العام صحة ما ورد في التقرير السنوي الصادر عن وزارة الخارجية الأميركية بخصوص الاتجار بالبشر لعام 2006 والمتضمن الإشارة إلى وجود قصور في الجهود المبذولة من قبل السلطنة في مكافحة الاتجار بالبشر ، وأعلن سعادته في تصريحات خاصة لـ(الوطن) أن السلطنة تعتزم إصدار قانون وطني مستقل لمكافحة الاتجار البشر ، وأن الموضوع قيد الدراسة ولم تنته الجهات المعنية بإعداد المشروع منه حتى الآن .وحول ما ورد في تقرير الخارجية الأميركية أكد سعادة المدعي العام أن الشريعة الإسلامية، والتي هي مصدر التشريع في السلطنة، قد جرمت الرق والاستعباد وكافة أنواع الجرائم الموجهة ضد الأشخاص بما فيها مسألة الاتجار بالبشر، ووفقا لهذا النهج التشريعي الإسلامي توالت التشريعات القانونية في الدولة مؤكدة ذات المبادئ التي تعطي للشخص حقوقه القانونية وتجرم كافة صور وأشكال الاتجار بالبشر.
اهتمام تشريعي
وفيما يتعلق باهتمام السلطنة بمكافحة الاتجار بالبشر وتجريمه، أكد سعادته أن السلطنة أولت اهتماما كبيرا لتجريم الاتجار بالبشر، سواء كان ذلك في القوانين الوطنية مثل قانون الجزاء العماني أو بالسعي نحو الانضمام إلى الاتفاقات الدولية والإقليمية التي تجرم الاتجار بالبشر، أو بإصدار قانون وطني مستقل لمكافحة الاتجار بالبشر، موضحا سعادته أن هذا الاهتمام الكبير يأتي نظرا لما تمثله هذه الظاهرة من خطر بالغ ، باعتباره شكلا بغيضا من أشكال الاسترقاق الذي يتنافى مع القيم والمبادئ الإنسانية، ولما تحظى به هذه الجريمة من اهتمام منقطع النظير باعتبارها انتهاكا صارخ لحقوق الإنسان .وحول جهود المشرع العماني لمواجهة هذه الجريمة، أكد سعادة حسين الهلالي "أن قانون الجزاء العماني الصادر بالمرسوم السلطاني رقم (7/74) جرم عدة أفعال تمثل صورا من جريمة الاتجار بالبشر مثل تجريم الحض على الفجور أو الدعارة عن طريق الإكراه أو الحيلة ، وكذلك الاعتماد في المعيشة على ما يكسبه الغير من ممارسة الفجور أو الدعارة تحت حماية أو سيطرة المستفيد أو المستغل"، وأضاف : كما جرم القانون إدارة محلات الفجور أو الدعارة أو المعاونة في إنشائها أو إدارتها ، والدعارة والفجور نظير أجر، وذلك في المواد(220 ـ 222 مكرر) ونص كذلك في المادتين (260) و(261) على تجريم استعباد الأشخاص أو وضعهم في حالة تشبه العبودية، أو إدخال أي إنسان إلى الأراضي العمانية بحالة العبودية أو الرق أو التصرف به على أي وجه كان أو استلامه أو إبقائه على حالة الرق.من جهة أخرى أكد سعادة المدعي العام أن المرسوم السلطاني رقم (37/2005م) بتاريخ 12/4/2005 صدر بالموافقة على انضمام السلطنة إلى اتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة عبر الوطنية والبروتوكولات الملحقة بها، والتي من بينها (بروتوكول منع وقمع ومعاقبة الاتجار بالأشخاص وبخاصة النساء والأطفال) الذي عالج الموضوع بالتفصيل الوافي فجرم مختلف صور الاتجار بالبشر وأورد أحكاما خاصة لحماية ضحاياه وغير ذلك من الأحكام الأخرى" .
حضور بالمحافل الدولية
أما عن الجهود التي بذلتها السلطنة على المستوى الدولي لمكافحة هذه الظاهرة ، قال سعادته : "السلطنة ممثلة باللجنة الفنية لدراسة اتفاقيات مكافحة الجريمة الإقليمية والدولية الصادر بتشكيلها قرار من مجلس الوزراء ، حرصت على المشاركة في الاجتماعات الخاصة بصياغة وإعداد الاتفاقية المشار إليها والبروتوكولات الملحقة بها في مختلف مراحل التفاوض بشأنها وحضور الندوات والفعاليات المرتبطة بها وأضاف: هذا كله يؤكد حرص السلطنة على السعي وباهتمام بالغ لمحاربة هذه الظاهرة الإنسانية .
وأشار سعادة حسين الهلالي المدعي العام إلى وجود مشروع قانون عربي موحد لمواجهة جرائم الاتجار بالأشخاص، وأيضا مشروع قانون موحد لمكافحة الاتجار بالأشخاص بين دول مجلس التعاون لدول الخليج العربي، اللذين وضعا على أساس من بروتوكول منع وقمع ومعاقبة الاتجار بالأشخاص وبخاصة النساء والأطفال المكمل لاتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة عبر الوطنية المشار إليها، ويهدفان إلى مساعدة الدول العربية لدى وضع كل منها لتشريع وطني لمواجهة جريمة الاتجار بالبشر، وقد تم عرض المشروعين على اللجنة في الاجتماعات والفعاليات المرتبطة بكليهما .
قانون جديد
وأكد سعادة المدعي العام أن السلطنة بصدد إصدار قانون وطني مستقل لمكافحة الاتجار بالبشر، ويتبين مما ذكر أن فكرة القانون الوطني لمكافحة الاتجار بالبشر ليست وليدة اليوم إنما أتت تأكيداً لما تضمنه قانون الجزاء العماني من نصوص تجرم عدة صور للاتجار بالبشر نظراً لتطور مفهوم هذه الجريمة، وكذلك التزاماً بأحكام اتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة عبر الوطنية والبروتوكولات الملحقة بها التي انضمت إليها السلطنة بموجب المرسوم السلطاني رقم (37/2005م).ونوه سعادته إلى أن الموضوع ما زال قيد الدراسة ولم تنته الجهات المعنية بإعداد مشروع القانون منه حتى الآن، ورغم ذلك يمكن القول : إن المشروع سيتضمن النص على تجريم مختلف صور وأشكال جريمة الاتجار بالبشر وتحديد العقوبة المناسبة لمرتكبيها، والإجراءات اللازمة لحماية ضحايا هذه الجريمة وغير ذلك من الأحكام الأخرى .وأضاف سعادته: من المحتمل أيضاً أن يتضمن المشروع نصاً على إنشاء لجنة وطنية لمكافحة الاتجار بالبشر ممثلة في عدد من الجهات المعنية في الدولة وكذا تحديد اختصاصات هذه اللجنة وذلك على غرار ما تم في قانون مكافحة المخدرات والمؤثرات العقلية الصادر بالمرسوم السلطاني رقم (17/99) ، وقانون غسل الأموال الصادر بالمرسوم السلطاني رقم (34/2002م).لم تسجل حالاتوشدد سعادة حسين الهلالي على أن الادعاء العام يؤكد كجهة قضائية مختصة بتلقي جميع البلاغات في القضايا الجنائية أنه لم تسجل لدينا أي حالة من حالات الاتجار بالبشر في السلطنة وأن ما ورد في التقرير المذكور لا أساس له من الصحة والواقع ، أننا على استعداد تام لتزويد المهتمين في هذا الجانب بالإحصائيات السنوية للقضايا التي تعامل معها الادعاء العام خلال السنوات الماضية" واختتم سعادته : "نؤكد في ذات الوقت أننا نسعى دوماً إلى تطبيق ما نصت عليه القوانين المعمول بها في البلاد وعلى تطبيق المبادئ والأحكام التي تتضمنها الاتفاقيات التي تكون السلطنة طرفاً فيها" .

أكد فضيلة الشيخ إبراهيم الصوافي الباحث بمكتب الإفتاء أن الله تعالى خلق الإنسان خلقا خاصا وميزه بميزات عن كثير من المخلوقات ، قال تعالي " ولقد كرمنا بني آدم وحملناهم في البر والبحر ورزقناهم من الطيبات ، وفضلناهم على كثير ممن خلقنا تفضيلا" ويقول جل شأنه "يا أيها الإنسان ما غرك بربك الكريم الذي خلقك فسواك فعدلك ، في أي صورة ما شاء ركبك" من خلال هذه الآيات الكريمة يتضح لنا حسن خلق الله للإنسان وتكريمه له ، فهو خليفة الله في الأرض، ولأجل قيامه بمهمة الخلافة سخر له ما في السماوات وما في الأرض .ويضيف: تجد المخلوقات المتنوعة كبيرها وصغيرها في برها وبحرها وجوها مسخرة للإنسان ليوظفها فيما يحقق له النفع ، ولذلك حرم الله سبحانه وتعالى الاعتداء على الإنسان وتوعد من يقتل نفسا بغير حق وأوجب الدية في القتل الخطأ،بل حتى في حال الاعتداء على أي عضو من الأعضاء في الجسد .ويؤكد الصوافي " بناء على ذلك فإن الإنسان ليس سلعة معروضة للبيع أو قابلة للتداول، بل كائن أصيل سُخرت له منافع الكون ولا يجوز تحويله إلى أداة تجارة تباع وتشترى، ومن وقع في ذلك فقد وقع في جريمة تضاهي القتل وقال العلماء من باع حرا ثم ندم وتاب فعليه أن يبذل ماله كي يخلصه من الرق الذي أدخله فيه بغير حق" .ويضيف " الإسلام كما تقدم يحرم الاعتداء على العرض أو استغلال الإنسان لأغراض مادية، يقول الرسول صلى الله عليه وسلم "كل المسلم على المسلم حرام دمه وماله وعرضه "، والمجتمع العماني مجتمع مسلم يتقيد في سلوكياته بالشرع الحنيف وهذه هي السمة الغالبة ، ولكن لو وجد بعض الأشخاص الذين لا يتقيدون بذلك فهذا لا ينعكس على الإسلام أو العمانيين ، فإنه ما من مجتمع من المجتمعات إلا وفيه خارجون على المألوف وحتى في أيام الرسول صلى الله عليه وسلم كان هناك المنافقون الذين حاولوا تشويه صورة الإسلام والمسلمين ، فلا يمكن أن نصف الإسلام بأنه دين غير جيد بسبب هؤلاء المنافقين.
رئيس غرفة تجارة وصناعة عُمان :التجاوزات تتم من خلال الوسطاء بالدول المصدرة للأيدي العاملة
رفض سعادة خليل بن عبدالله الخنجي رئيس غرفة تجارة وصناعة عمان ما ورد في تقرير وزارة الخارجية الاميركية الذي زعم أن السلطنة لم تبذل جهودا كافية لمكافحة ظاهرة الاتجار بالبشر، ولم تتلق أي شكاوى حول وجود تجاوزات في هذا الشأن في وقت تبدو فيه تلك التجاوزات ظاهرة عالمية.وقال سعادته: إن أصحاب الأعمال شاركوا في ندوة حول "ظاهرة الاتجار في البشر" على هامش مؤتمر العمل الدولي الذي انعقد الشهر الماضي ، وشاركت في الندوة الدول المصدرة للأيدي العاملة بعقود مؤقتة والتي من بينها الهند وباكستان وبنغلاديش وسريلانكا وبحضور الدول المستقبلة للأيدي العاملة وهي دول مجلس التعاون الخليجي علاوة على الأردن .وكانت النقاط المثارة كقطاع خاص أن التجاوزات تتم من خلال مكاتب السفر والوسطاء، أما في الدول المستقبلة لتلك الأيدي العاملة فإنه إذا كانت هناك تجاوزات من خلال الأفراد والمؤسسات فهناك قوانين وشرطة وهيئات حكومية معنية بمواجهة هذه الظاهرة، وهو ما ينطبق على السلطنة أيضا .ووجه سعادة رئيس غرفة تجارة وصناعة عمان نصيحة بضرورة توخي الدقة في كل التقارير لأن المعلومات المغلوطة تؤثر على التنمية الاقتصادية في السلطنة وتؤدي إلى تباطئها وبنفس المقدار ستؤثر على الولايات المتحدة الاميركية التي ترتبط بعلاقات اقتصادية مع بلادنا، وأكد سعادته أن غرفة تجارة وصناعة عمان مستعدة للتعاون مع الجهات الاميركية لرفع أي لبس، وفتح كل الملفات لمواجهة أي تجاوزات .

Anti-human trafficking law soon
MUSCAT Last June, Omanis and expatriates were shocked by the annual report issued by the US State Department on alleged human trafficking in the Sultanate and other GCC states. The report accused the GCC governments of their failure in preventing human trafficking and meeting the international standards relating to it. The most shocking was that the Sultanate was ranked at third making it liable for US sanctions.
It should be noted that the report was full of contradictions and baseless allegations. The study prepared by the Global Peace Index pointed out that the Sultanate was one of the most stable countries in the Middle East and North Africa. The Sultanate was also ranked among the top countries in respecting human rights.
Commenting on the content of the report, HE Hussein Bin Ali Al Hilali, Prosecutor General said: “Islamic Sharia, which is the main source of legislation, has strictly prohibited slavery and crimes against humanity, including human trafficking. The basic statute of the state protects human rights and criminalises all forms of human trafficking.”
The Sultanate’s law has shown much concern in prohibiting all forms of human trafficking. The Sultanate has also signed international and regional agreements that prohibit human trafficking.
The Omani penal law issued by the Royal Decree No.7/74 has criminalised various forms of human trafficking including inciting practice of adultery. Articles 220 and 222 prohibit dependence on the money earned from adultery and ban prostitution houses and the act of indulging in adultery in return for money. Articles 260 and 261 criminalise slavery of humans or subjecting them to semi-slavery conditions. The law also prohibits granting any human being access to Omani lands as a slave.
The Royal Decree No.37/2005 issued on April 12, 2005 approved the Sultanate signing of the UN Agreement on combating organised crime which has a number of protocols, including ban on human trafficking especially women and children. The protocol criminalises all forms of human trafficking and lays down a number of provisions that protect victims of human trafficking.
The Sultanate, represented by the technical committee for studying the regional and international crime combating agreement, has shown interest and concern in drafting the UN Agreement on combating organised crimes and its protocols. The committee has taken part in a number of seminars and forums on combating all forms of human trafficking.
Al Hilali said that the process was under way to issue a standardised Arab law that criminalises all forms of human trafficking. A similar law among GCC states is also in the pipeline.
He also said that the Sultanate will issue a national law on combating human trafficking. The law is expected to criminalise all forms of human trafficking and set appropriate penalties for offenders.
The draft law may also includes the creation of a national committee for combating human trafficking and assign the responsibilities of such committees, as was the case with the Anti-Drug Law issued by the Royal Decree No.17/99 and Money Laundering Law issued by the Royal Decree No.34/2002.
Al Hilali affirmed that not even a single case was reported to the general prosecution, which has the legal jurisdiction over such cases, therefore the allegations stated in the reports were false and baseless.
“We are ready to provide those interested in the issue with the statistics we have,” he added. Al Hilali said the Sultanate is always committed to implementing the provisions of all the agreements it signs.
HE Khalil Bin Abdullah Al Khonji, Chairman of the OCCI, dismissed the allegations made by the US State Department report about the Sultanate’s inadequate efforts to combat human trafficking.
Al Khonji said that a number of Omani businessmen participated in International Labour Conference held last month. The Sultanate also participated in the conference of labour-exporting countries like India, Pakistan, Bangladesh, Sri Lanka and labour importing countries, including GCC states and Jordan.
The participants affirmed that violations were not committed by governments but by travel agents and recruitment agencies in the labour-importing countries. They also highlighted the efforts made by the legal and police authorities in these countries, including Oman.
Al Khonji called upon those in charge of preparing such reports to be accurate because publishing false and baseless data may have a negative impact on the economic performance of any nation. Al Khonji said the OCCI was ready to cooperate with the US agencies to find out the truth and prevent any violation.

I was surprised by this report also. I wonder what the evidence was that they used to form these charges. I can't imagine that they just made it up.
Why does the title say that a new law is to be passed soon? Does that mean that there is going to be a positive response from Oman?

We have a law that our State Department is supposed to review human rights practices in all foreign countries. The reason was that many years ago, we used to just ignore completely what the human rights problems were and just have relations with whoever was useful to us. So we created a system to keep track of and evaluate human rights in all countries.
It's not supposed to be telling other countries what to do. It's supposed to help us decide what we should do.
We have a problem with trafficking persons and we prosecute people for it. But Oman last year apparently prosecuted zero people. And certainly Oman has a problem, just as all countries do.
We certainly have problems in the United States. I think it's very fair for Oman to point out problems it sees in the US and vice versa. If it's done in the right spirit, then we can all benefit.

Once, I watched in news that USA accuses Dubai for not providing good conditions in the work place…while in fact, they do their best to make workshop or work place a better and safer place for all workers….to make good job, they should provide a good atmosphere for the workers to do their job in best way.
Oman doesn't need anyone to remind her to do the good actions…I always watch in news that Oman agrees on any good resolution by any trusted organization…. All good resolutions are acceptable here…. Oman always supports any thing which can help our world to be a better world. Maybe I'm not expert or a employee in Oman government, but I can see well how my beloved country support any good agreement. Unfortunately, USA doesn't support any good agreement unless it doesn't conflict with its interests.
Well, good system…but it will better if they track that inside USA before outside USA.
It will be okay if USA cooperates with other countries "Friendly" to solve any common problem that existing in many countries…that will be nice, but what I see that USA thinks that no one has the right to accuse USA while USA has the complete right to attack any country…whether by reports, threats, or even invasions.

Well, you might be right. But still, I think it's healthy for us to criticize each other openly. Then if we believe our friends are making mistakes about us, we can always reply.
You have to remember too that we criticize ourselves also. Our Congress criticizes our President, the President criticizes the Congress, one branch of the government criticizes another or even criticizes itself.
And many times we say, We are not doing a good enough job. We have to do better.
Many people in the US Government criticize our policies about illegal aliens in America, just like you do. They say, We are failing to do enough to treat aliens fairly. So I think it's not such a terrible thing if we say, Oman is not doing enough to combat human trafficking.
